Corporate Year 2000 Compliance Legal Statement
For all products that are described as Year 2000 compliant,
(including all versions of Intersection Magic and Map Magic)
Pd' Programming, Inc. represents that the programs, files, data bases
and/or functionalities of such product are no more likely to
produce logical or arithmetical inconsistencies when dealing
with dates beyond December 31, 1999 than they are when
dealing with dates prior to December 31, 1999.
Pd' Programming, Inc. does not warrant the interoperability of its software
with any third party software, systems, or products.
In the event a Licensed Product fails to accurately process
data that includes or references such dates, Pd' Programming, Inc. sole
obligation, and Licensee's exclusive remedy, shall be to
provide services in accordance with the applicable warranty
provision or software maintenance agreement between the
parties.
EXCEPT AS EXPRESSLY PROVIDED HEREIN,
Pd' Programming, Inc. MAKES NO WARRANTY OF ANY
KIND, WHETHER EXPRESS OR IMPLIED, WRITTEN
OR ORAL. SPECIFICALLY, Pd' Programming, Inc. MAKES NO
IMPLIED WARRANTY OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE OR
FREEDOM FROM INFRINGEMENT FOR THE
LICENSED PRODUCTS.
In no event shall Pd' Programming, Inc. or any of its suppliers be liable for
damages resulting from loss of data, LOSS OF profits in
connection with use of any Licensed Products or other items
provided, nor for costs of procurement of substitute goods,
property damage, personal injury, or any other special,
indirect, incidental, or consequential damages arising out of or
in connection with ANY Pd' Programming, Inc. PRODUCT whether
in breach of warranty, contract, tort, strict liability or otherwise
even if Pd' Programming, Inc. has been advised of the possibility of such
damages.
